The use of this web platform, as well as any transaction carried out through it, is considered to be carried out in Spain and, therefore, is subject to current Spanish laws and regulations, all without prejudice to the legislation that would be applicable according to the consumer’s status.

These General Conditions are intended to establish the regulatory framework for the conclusion of the Contract. These conditions will be supplemented, where appropriate, by the corresponding Particular Conditions.

In your status as a Consumer, the Contract concluded is governed by Royal Legislative Decree 1/2007 of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws (hereinafter referred to as TRLGDCU).

 

CONTRACTING PROCEDURE. HOW CAN I BUY ONLINE?

 

In order for you to access the products offered by MASOS VALLE DE GUADALEST and make a purchase, you must freely and voluntarily provide the personal data that will be required of you.

Please be informed that, in accordance with the requirements of Art. 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow these steps:

In case of identifying any error in data entry, the user can follow these steps:Client Area: Access the client area using the credentials provided during the registration process. Identify the corresponding transaction and select the data correction option. Modify the incorrect data and confirm the changes.Customer Service: In case of preferring direct assistance, the user can contact our Customer Service through the enabled communication channels, indicating what information is erroneous and providing the correct information for immediate update.

It is important to highlight that once the transport company takes charge of the product, any request for changes related to delivery must be made directly with the transport company, using the tracking number provided. Data rectification in this context will be subject to the transport company’s criteria.

Likewise, you must bear in mind that, for security reasons, if you choose PayPal as a payment method, once the order has been placed, no changes of any kind in the delivery address will be allowed.

The descriptions of the products offered on our portal are based on the product catalog of MASOS VALLE DE GUADALEST.

The products we present on our website are carefully selected from our collection. We have dedicated special attention to displaying the colors and characteristics of our products with great precision. However, due to variability in the quality or resolution of the monitors or devices used by users, it is important that they carefully review the product description in the purchase file, as this is not subject to such contingencies.Furthermore, to provide more complete information, we will also indicate the stock availability of the product. In the event that an error occurs whereby a product is shown as available but is not after the purchase has been made, MASOS VALLE DE GUADALEST will inform the user of this situation in accordance with what is established in our section “RETURNS POLICY – Lack of stock”.

 

PRICE INFORMATION

 

The price of each product will be the one indicated on our website at the time of purchase and these will be expressed in Euro currency (€). Unless otherwise stated, the prices of products shown on our website include legally applicable taxes (Spanish VAT).

Additionally, shipping costs and applicable taxes will appear itemized at the time of purchase, on the payment screen, so that the user can know precisely the final price of the product and understand its composition.It is important to keep in mind that prices can vary at any time, although such modification will not affect orders that have already been placed.

Our goal is to maintain a transparent relationship with our clients and address any error fairly and efficiently. Therefore, although we strive to ensure the accuracy of all prices on the page, we recognize that an occasional error may arise. In case of detecting a manifest error in the price of a product that you have ordered and that can be effectively proven, we commit to informing you immediately. In such a situation, we will provide you with the option of reconfirming your order at the correct price or, alternatively, of canceling it if you so prefer, prior to the order confirmation sent to the provided email address, at which time the due perfection of the contract will occur, in accordance with applicable regulations.

 

SALES PROMOTION

 

The following shall be considered sales promotion activities:

  • Sales at reduced prices (rebajas).
  • Offer or promotion sales.
  • Clearance sales (saldos).
  • Liquidation sales.
  • Sales with gifts.
  • Direct sales offers.

In all cases where our entity carries out any of the above sales, the announcement will specify its duration and, where appropriate, the special rules applicable to them. The duration of each sale period will be freely decided by the Entity.

In the case of items with price reduction, the previous price will appear along with the reduced price, except in the case of items offered for sale for the first time.

If the announced sales do not include the information set out in the previous paragraphs, it will be understood, as indicated in these conditions and in this section, that the price may vary depending on demand, not responding to a specific period or a specific promotion. That is, they will be RRP (recommended retail prices).

In the case of sales with a gift or incentive, this may be delivered within the period determined by the sale without exceeding that established in each Autonomous Community, which in any case will not be more than three months from the expiration date of the promotion.

 

SHIPPING COSTS

 

We offer free shipping for all orders placed for the mainland that exceed 100 euros. This option is available to our customers as an additional benefit when making purchases of a certain value. Not applicable to Canary Islands, Balearic Islands, Ceuta, and Melilla.

In the case of orders that do not reach the aforementioned amount, a standard shipping fee starting from 8 euros will apply. The exact cost of shipping will be calculated during the purchase process and will be clearly displayed before confirming the transaction. This rate will vary depending on the destination of the shipment and the weight of the package.

 

PRICE PER UNIT OF MEASURE

 

The price per unit of measure will be clearly visible in each publication of our products. Therefore, our customers will have easy and direct access to this information when making their purchase.

 

OFFER AND ACCEPTANCE

 

The contracting procedure and the pre-contractual information are in Spanish. This is the language that will be used to carry out the contracting. In case it can be carried out in another language, it will be indicated before starting the contracting procedure.

The payment of the price through the web is made at the time of purchase and MASOS VALLE DE GUADALEST will send you a confirmation e-mail of the purchase made informing about the scheduled date for the reception of the product.

MASOS VALLE DE GUADALEST states that it does not have access to or store sensitive data related to the payment method used by the User, except those strictly necessary for its management. Only the corresponding financial entity processing the payment has access to these data for the management of payments and collections. Once the purchase process is finished, an electronic document is generated in which the contract is formalized and which the user may print.

MASOS VALLE DE GUADALEST reserves the right to cancel orders in accordance with these conditions. You can consult the reasons for cancellation in the specific section that regulates them.

  •   What payment method can I use to make my online purchase?

The payment for the products offered by the entity may be made through:

  1. Credit or debit card. Visa, MasterCard, Maestro. If your payment method is a bank card, by clicking on “Order with obligation to pay” you are confirming that the credit card is yours. If you receive a notification that your card has been rejected and you have verified that the card has not expired and that the information number associated with your card does not contain any errors, you should contact your bank first to find out the reason for the rejection or lack of authorization.
  2. If you choose PayPal as a payment method, once the order has been placed, no changes of any kind in the delivery address are allowed.
  1. Google Pay and Apple Pay.
  2. Discount coupons. There are no discount coupons as such; they are gift cards purchased previously.

Once the order has been made, the company will confirm your order immediately. These General Terms and Conditions will remain on this website and must be accepted by you before making the payment. 

  • Is it safe to enter my credit card details on the website?

As you can see in our security policy, our payment is secure using the indicated means. Our online store has an SSL certificate that allows us to protect the bank information transferred during the purchase process using encryption methods.   • My card has been rejected, what can I do?

If you receive a notification that your card has been rejected, you should contact your bank first to find out the reason. However, this circumstance can occur for several reasons:

When making payment through the secure payment gateway, the system will automatically verify that the card is activated for Secure Electronic Commerce. Next, it will connect with the financial institution that issued it, which will request the buyer to authorize the transaction through a personal authentication code. The transaction will only be carried out if the card’s issuing bank confirms the authentication code, and at that time the card will be charged. Otherwise, the transaction will be rejected.
  2. The card may be expired. Check that your card does not exceed the validity date.
  3. Credit limits or holding of funds. The card limit for making purchases may have been reached.
  4. Incorrectly entered data. Check that you have filled in all the necessary fields with the correct information.

In any case, your bank is the only one that can provide you with the exact reason why a payment has been rejected.

  • My card has been used fraudulently, what should I do?

You must notify MASOS VALLE DE GUADALEST through email or by telephone of any improper or fraudulent charge on the card used for purchases on the website, in the shortest possible time, so that MASOS VALLE DE GUADALEST can carry out the management it deems appropriate.

  •   Information about the invoice

The company generates invoices in electronic format provided that you authorize us previously at the final time of purchase. If you have not marked the consent to receive the invoice in electronic format, we will provide your invoice on paper along with the shipment of the order given that this will be the format established by default.

 

INFORMATION FOR CONSUMERS REGARDING OFFERED PRODUCTS (FOOD)

 

Complying with the requirements of the food information regulation No. 1169/2011. In each publication of our products, we offer a downloadable PDF that includes the list of ingredients, the quantity of certain ingredients or categories of ingredients, as well as the complete nutritional information.24

Additionally, the images in each publication also include relevant information about the ingredients and nutritional information.

At the time of finalizing the purchase, all these data will be available for review, ensuring that our customers have access to the information necessary to make informed decisions about their purchases.

 

SHIPPING POLICY

 

  • Delivery time

The maximum period for product delivery is 72 hours, on business days in the mainland (excluding Canary Islands, Balearic Islands, Ceuta, and Melilla), once payment has been made according to the chosen method. In the event that, due to any circumstance, the order cannot be delivered within the established period, we will notify you as soon as possible.

It is important to highlight that all the periods mentioned are in business days and are subject to confirmation of payment according to the selected method. In the event that a delay occurs in delivery, we commit to informing you without delay.

  • Place of delivery

MASOS VALLE DE GUADALEST undertakes to deliver the product in perfect condition to the address you have indicated, which must be located in mainland Spanish territory. In case of needing shipment to the Canary Islands, Balearic Islands, Ceuta, and Melilla, please contact us at the email bodega@masosguadalest.com and we will offer you a personalized shipping quote. To guarantee a successful delivery, it is important that the address provided be accessible during usual working hours.

It is important to keep in mind that MASOS VALLE DE GUADALEST does not assume any responsibility in case the delivery of the product is not carried out due to incorrect, inaccurate or incomplete data provided by the user. Likewise, MASOS VALLE DE GUADALEST will not be responsible in cases where the delivery cannot be made due to causes beyond the assigned shipping company, such as the recipient’s absence.

  • Transmission of risk and property

The delivery is considered carried out from the moment the product has been placed at the disposal of the User or a third party indicated by him (other than the carrier) at the indicated delivery location. The risk of the products (among others, loss, impairment or theft) will be transmitted to the User from the moment the products have been made available to him. However, in the event that the consumer and user commissions the transport of the goods or the chosen carrier was not among those proposed by the businessman, the risk will be transmitted to the consumer and user with the delivery of the goods to the carrier, without prejudice to his rights against the latter.

  • Problems in delivery

If there were any visible discrepancy or problem in the order at the time of delivery, you must not accept the delivery and must state it on the delivery note or means used by the carrier.

In case of accepting the order with notable damage or defects perceptible to the eye, there may be problems with its return. However, both in those cases and in those where the defects were detected at the time of opening the package, you must immediately contact us through our email bodega@masosguadalest.com leaving us your personal details and order number, a photograph, description of the discrepancy or problem, and we will shortly contact you to try to solve the incident.

 

LEGAL WARRANTY

 

The User may exercise the legal warranty of THREE YEARS for non-perishable products or services in accordance with current regulations on consumer product warranties, as established in Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.

For products that expire quickly, the legal warranty operates in the case of incorrect products, products in poor condition, or with defects. In such case, MASOS VALLE DE GUADALEST will proceed to refund the full amount using the same payment method chosen by the customer, within a maximum period of 14 days. For this, the customer must contact TECNOLOGÍAS Y LOGÍSTICAS APLICADAS SL within 24 hours of receiving the product, through the contact email bodega@masosguadalest.com, indicating the error or defect along with their personal and order data. The warranty covers shipping costs, free replacement in our warehouses, and transport costs back to the customer. In case of an erroneous or expired product, TECNOLOGÍAS Y LOGÍSTICAS APLICADAS SL may opt to replace, reduce, or terminate the contract, procedures that will be free for the consumer and user.

All our products are covered by the legal warranty of conformity established by consumer protection regulations. This means that our products:

  • Comply with the description provided on our website.
  • Are suitable for the uses for which products of the same type are ordinarily intended.
  • Display the usual quality and performance of a product of the same type that the consumer and user can expect.

If the product purchased has a defect or does not match the characteristics described, the consumer must contact us through our customer service within two months from becoming aware of the lack of conformity. Our team will evaluate the situation and, if necessary, proceed with repair, replacement, or refund of the product.

In compliance with the LSSI-CE and the Organic Law on the Protection of Personal Data (LOPD), we guarantee that the personal data of our clients will be treated confidentially and only for purposes related to the management and shipment of the purchased products.

RETURNS POLICY

  • Right of withdrawal

Article 102 of the General Law for the Defense of Consumers and Users (LGCDU) establishes that consumers and users shall have the right to withdraw from the operation during a period of fourteen calendar days, without the need to indicate the reason.

However, the product/service offered by MASOS VALLE DE GUADALEST falls within the exceptions to that right, provided for in Article 103 of the LGCDU:

  1. g) The supply of alcoholic beverages whose price was agreed upon at the time of concluding the sales contract and which cannot be delivered before 30 days, and whose real value depends on fluctuations in the market that the entrepreneur cannot control.

For that reason, “once we have processed and sent your order”, you will not be able to exercise the right of withdrawal.

 

  • Refund

Whatever payment system you use, the refund of the amount will be initiated as soon as possible but always within a period of 14 days following the receipt of the product in our warehouses. In the case of having made the payment by transfer, to carry out the return you must attach an account number to the return form where we can make the deposit.

  • Lack of stock

In the event that all units of the product purchased are exhausted, the Customer Service department will communicate this fact as soon as possible through the contact details provided during the purchase process. In this situation, MASOS VALLE DE GUADALEST undertakes to carry out the refund of the purchase amount immediately and, in any case, without undue delay.

 

MINORS

 

Access to and contracting of products on this website are reserved exclusively for persons over eighteen (18) years of age, in accordance with Article 1263 of the Civil Code. If a minor wishes to acquire our products, the purchase must be formalized by their father, mother, or legal guardian, who will assume all contractual obligations and the veracity of the data provided. Parents or legal guardians are urged to supervise minors’ activities online and to ensure that they do not make purchases without due authorization. MASOS VALLE DE GUADALEST is not responsible for purchases made by minors without the authorization of their legal representatives nor for any inaccurate data they may provide.

 

CONFLICT RESOLUTION

  •   Applicable law and jurisdiction

The relationship between MASOS VALLE DE GUADALEST and the Consumer and User will be governed by current Spanish regulations. In accordance with the provisions of Article 90.2 of the TRLGDCU, all disputes and claims derived from this legal notice will be resolved by the Courts and Tribunals of the consumer’s domicile.

If at any time you consider that your rights as a consumer have not been respected or you have a complaint about our products or services, we offer you the possibility of requesting Complaint Forms.

Your opinion is important to us and we will strive to resolve any problem or inconvenience fairly and transparently.

  •   Out-of-court settlement of disputes

  • Intellectual Property Claims

MASOS VALLE DE GUADALEST respects the intellectual property of third parties. If you consider that your intellectual property rights may have been infringed, please communicate this incidence to the email bodega@masosguadalest.com providing the following information:

  • Detailed description of the work protected by intellectual property rights that you consider has been infringed.
  • Clear and specific identification of the exact location on our website where the allegedly infringing content is located.
  • Sufficient contact information.
  • A statement in which you manifest in good faith that the use of the content in question is not authorized by the holder of the intellectual property rights, their legal representative, or the law.
  • A statement affirming that the information provided in your notification is accurate and that you are the holder of the intellectual property rights or authorized to act on behalf of the holder.
